Ein gewisser Anreiz des Verwalters, Betriebe zur Vermeidung von Haftungsgefahren in der Tendenz früher als erforderlich einzustellen, liegt daher nahe. Die Studie untersucht die wechselvolle Haftung des Konkurs- bzw. Insolvenzverwalters und nimmt dabei auch wahrnehmungspsychologische Anreizeffekte in den Blick. Ausgangspunkt der Analyse bilden die Zwangsvergleichsbürgen-Urteile, in denen das Reichsgericht mit einer ausgewogenen Haftungsrechtsprechung Sanierungen zu einer Zeit förderte, die in der Rückschau als sanierungsfeindlich eingestuft wird
