Beherrschungspositionen auf Telekommunikationsmärkten und daraus resultierende Marktmachtübertragungen in benachbarte Märkte gehören zu den typischen Wettbewerbsproblemen in der Telekommunikation. Art. 14 Abs. 3 Rahmenrichtlinie ermöglicht den Regulierungsbehörden, Marktmachtübertragungen durch beherrschende Telekommunikationsunternehmen mittels gezielter Maßnahmen zu verhindern. Die Autorin untersucht die Tatbestandsvoraussetzungen und Rechtsfolgen der Regelung und zeigt u.a. anhand konkreter Marktkonstellationen deren Anwendungsmöglichkeiten in der Regulierungspraxis auf. Ein Schwerpunkt liegt bei der Beantwortung der Frage, unter welchen Voraussetzungen Märkte als benachbart anzusehen sind. Dabei werden im Rahmen der Auslegung Erkenntnisse auch aus dem Bereich der Fusionskontrolle und dem allgemeinen Wettbewerbsrecht herangezogen. Untersucht werden außerdem Regulierungsmöglichkeiten bei drohenden Leverage-Effekten durch gemeinsam marktmächtige Unternehmen.
