Bereits im Jahre 1949 verabschiedete die International Labour Organisation (ILO) das Übereinkommen Nr. 94, welches vorschreibt, dass die öffentliche Hand bei Vergabe eines Auftrags vom bietenden Unternehmer die Einhaltung von Sozialstandards zu verlangen hat. Der Unternehmer muss sich verpflichten, seinen Mitarbeitern bei Auftragsausführung adäquate Arbeitsbedingungen zu gewährleisten. Deutschland hat das Übereinkommen Nr. 94 bisher nicht ratifiziert. Die Untersuchung geht der Frage nach, ob eine Umsetzung des Übereinkommens im Hinblick auf verfassungs- und unionsrechtliche Vorgaben noch möglich ist. Dies wird auch anhand sogenannter Tariftreuegesetze überprüft, die auf Landesebene zum Teil bestehen und bereits dem BVerfG und dem EuGH zur Prüfung vorlagen.
