Das Inter-Amerikanische Menschenrechtssystem kennt neben einer Menschenrechtskonvention auch eine Amerikanische Deklaration der Rechte und Pflichten des Menschen. Ursprünglich war diese ein rechtlich unverbindliches Bekenntnis zur Verbesserung des regionalen Menschenrechtsschutzes. Die Arbeit untersucht, ob sich diese Deklaration im Wege einer evolutiven Auslegung der OAS-Charta heute zu einem verbindlichen menschenrechtlichen Mindeststandard für alle OAS-Staaten verdichtet hat. Dabei wird die Praxis der OAS-Mitgliedsstaaten und Organe analysiert und die völkerrechtlichen Auslegungsregeln, insbesondere die spätere Übung, sowie das acquiescence-Prinzip dogmatisch vertieft behandelt. Die Arbeit wurde mit dem Forschungsförderpreis der Freunde der Universität Mainz e.V. ausgezeichnet.
