Seit dem Aufkommen der Finanzmarktkrise im Jahre 2007 ist die Regulierung der Finanz- und Kapitalmärkte eines der bestimmenden Themen der politischen und gesellschaftlichen Diskussion. Als eine der wesentlichen Lehren aus der Finanzmarktkrise wird in der Öffentlichkeit insbesondere die Regulierung von Leerverkäufen propagiert, da Leerverkäufe als ein wesentlicher Faktor für die Entstehung der Finanzkrise ausgemacht wurden. Diese Arbeit widmet sich daher der Frage, auf welche Ursachen die Finanzmarktkrise zurückzuführen ist und ob der Gesetz- bzw. Verordnungsgeber durch die Regulierung von Leerverkäufen in rechtlich, rechtsökonomisch bzw. rechtspolitisch angemessener Weise auf die Krise reagiert hat.
