Kann Hamburg auf gesetzlicher Grundlage gegenüber dem Bund einen Ausbau der Elbe verlangen? Das Deutsche Reich hat sich in den Jahren 1921/1922 gegenüber Hamburg zur Übernahme von Ausbaumaßnahmen zur Erreichbarkeit des Hamburger Hafens für „die größten Seeschiffe" verpflichtet. Das vorliegende Werk weist nach, dass diese Verpflichtung über eine Verweisung in § 12 Abs. 4 WaStrG heute die Bundesrepublik Deutschland trifft, womit unter Zugrundelegung der Schutznormtheorie ein subjektiv-öffentliches Recht Hamburgs korrespondiert. Reichweite dieses synallagmatischen Verhältnisses ist die Priorisierung des Hamburger Hafens bei der Wasserstraßenausbaubedarfsplanung des Bundes. Um der mit subjektiven Rechten versehenen Position Hamburgs verfahrensrechtlich besser Rechnung zu tragen, wird vorgeschlagen, die Rolle der Hansestadt in den Planfeststellungsverfahren durch die Beteiligung an einer Wasserbaugesellschaft, der die Vorhabenträgerschaft übertragen werden kann, aufzuwerten.
