Der Verfasser versteht das aus der menschlichen Vernunft geschaffene Recht mit Kant als Grenze der Freiheit des in Gemeinschaft lebenden Menschen gegenüber den gleichartigen Freiheiten der anderen. Er zeigt, wie mühsam sich in der christlichen Welt dieses zuerst von Thomas v. Aquin entwickelte rationale Rechtsverständnis gegen die Glaubensvorstellung göttlichen Rechts durchsetzen musste. Im Islam wird dagegen das Recht immer noch als göttliches Recht verstanden, das der Mensch nicht ändern darf; es gibt daher unter diesem Glauben auch keine Trennung von Religion und Recht. In den christlichen Staaten und speziell im Deutschland des 20. Jahrhunderts wurde das Recht dagegen im Positivismus „entleert“, ideologisch „aufgefüllt“ (NS-Faschismus und DDR-Sozialismus) und so zu schrecklichem Unrecht. Horst Ehmann versteht es meisterhaft, die Entwicklungsgeschichte der ewigen Auseinandersetzung zwischen Vernunft, Religion und Ideologie auch für Nichtjuristen spannend und verständlich darzustellen.
