    Note: Vorbemerkung. -- Erste Sitzung. Sonntag, den 11. October. -- Referat des Prof. Dr. A. Held (Bonn) über die Bestrafung des Arbeitscontractbruchs. -- I. Der Bruch des Arbeitsvertrags so wie die directe oder indirecte Verleitung zu demselben erscheint nicht nur als ein namentlich die Landwirthschaft und das Kleingewerbe schwer schädigendes wirtschaftliches Uebel, sondern vor Allem als ein schweres Unrecht, das vom moralischen Standpunkt durchaus verdammt werden muß und dessen Bestrafung juristisch durchaus zulässig ist. -- II. Das häufige Vorkommen des Contractbruchs erzeugt und befördert sittliche Verwilderung des Arbeiterstandes. Indessen ist dasselbe doch vor Allem als Folge tiefer liegender Verwirrung in den gewerblichen Verhältnissen zu betrachten. Daher erscheinen die practischen Folgen einer Contractbruchsstrafe als sehr zweifelhaft, was um so mehr zu beachten ist, als eine solche juristisch zulässig, aber nicht geboten ist. -- III. Ein gesetzliches Einschreiten zur Sicherung des Arbeitsvertrags als der Anfang positiver socialer Gesetzgebung kann nicht empfohlen werden, ehe durch gründliche und unparteiische Untersuchung der Umfang und die gewöhnlichen Ursachen des Contractbruchs und durch Befragung von Sachverständigen aller Parteien die wahrscheinlichen Vorzüge und Nachtheile der Bestrafung gegenüber anderen sehr zu erwägenden Mitteln zur Bekämpfung des Uebels festgestellt sind. -- IV. Ein solches gesetzliches Einschreiten in Form eines isolirten Contractbruchsgesetzes ist auch als inopportun zu bezeichnen, solange die Gesetzgebung nicht entschlossen ist, andere wichtigere sociale Fragen gleichzeitig zu regeln, und solange dieselbe sich über die dabei zu befolgenden Principien nicht völlig klar ist. Denn der unverkennbare Zusammenhang der Contractbruchsfrage mit anderen socialen Fragen bewirkt, daß ein isolirtes Contractbruchsgesetz nothwendig ein sehr lückenhaftes Gesetz bleiben muß. Ein lückenhaftes Gesetz aber kann seine beabsichtigten Wirkungen nicht erreichen und wird leicht geradezu falsch wirken. -- Correferat des Redacteurs I. F. H.     Content: Data are considered to be key for the functioning of the data economy as well as for pursuing multiple public interest concerns. Against this backdrop this book strives to device new data access rules for future legislation. To do so, the contributions first explain the justification for such rules from an economic and more general policy perspective. Then, building on the constitutional foundations and existing access regimes, they explore the potential of various fields of the law (competition and contract law, data protection and consumer law, sector-specific regulation) as a basis for the future legal framework. The book also addresses the need to coordinate data access rules with intellectual property rights and to integrate these rules as one of multiple measures in larger data governance systems. Finally, the book discusses the enforcement of the Government’s interest in using privately held data as well as potential data access rights of the users of connected devices.

    Content: This volume presents modern trends in the area of symmetries and their applications based on contributions to the workshop "Lie Theory and Its Applications in Physics" held in Sofia (Bulgaria) in June 2023. Traditionally, Lie theory is a tool to build mathematical models for physical systems. Recently, the trend is towards geometrization of the mathematical description of physical systems and objects. A geometric approach to a system yields in general some notion of symmetry, which is very helpful in understanding its structure. Geometrization and symmetries are meant in their widest sense, i.e., representation theory, algebraic geometry, number theory, infinite-dimensional Lie algebras and groups, superalgebras and supergroups, groups and quantum groups, noncommutative geometry, symmetries of linear and nonlinear partial differential operators, special functions, and others. Furthermore, the necessary tools from functional analysis are included. This is a large interdisciplinary and interrelated field.
