Abstract:
The 'De-materialisation' of Authentic Transactions in French Law. The law of 13 March 2000 which amended the law surrounding evidential proof in information technology and electronic signatures represented the modernisation of French civil law when faced with a new situation created by commercial electronic transactions. The authors demonstrate that the three principle elements of the amendment -the differentiation between the information and its medium, a definition of the electronic signature, based on cryptography, and authentic electronic transactions -were a response to distinct problems, and not necessarily reconcilable. It is suggested that the archival approach to problems of intelligibility and authenticity of electronic documents offers a more satisfactory basis on which to respond to the issue of the evidential weight of electronic documents.
