§§ 7, 19, 20, 21 Abs. 6 SGB II 1. Eine temporäre Bedarfsgemeinschaft besteht nur, wenn der existenznotwendige Bedarf eines Kindes während seines Aufenthalts im Haushalt des umgangsberechtigten Elternteils nicht aus dessen einzusetzendem Einkommen und Vermögen aufgebracht werden kann. 2. In diesem Fall ist bei einem Aufenthalt von 12 oder mehr Stunden das Sozialgeld (jetzt Bürgergeld) entsprechend der Zahl der Aufenthaltstage aufzuteilen, um die Deckung des Lebensbedarfs des Kindes zu gewährleisten. 3. Führt eine damit verbundene Kürzung des Regelbedarfs in der ersten Bedarfsgemeinschaft dazu, dass der verbleibende Betrag nicht mehr genügt, um den dort aufzubringenden existenznotwendigen Bedarf zu sichern, kommen für das Kind in dieser Bedarfsgemeinschaft weitere Leistungen über den Härtefallmehrbedarf in Betracht (BSG v. 14.12.2021 – B 14 AS 73/20R). Das Konzept des § 21 Abs. 6 SGB II lässt jedoch keine Pauschalierung solcher Mehrbedarfe zu, sondern erfordert einen im Einzelfall nach Grund und Höhe nachzuweisenden Bedarf.
