Das Ausmaß der Seeräuberei in manchen Seeregionen hat die Staatengemeinschaft dazu veranlasst, verstärkt militärische Mittel zu deren Bekämpfung einzusetzen. Dazu leistet auch Deutschland einen Beitrag. Besondere Aufmerksamkeit hat die Beteiligung der Bundeswehr an der militärischen Operation der EU «Atalanta» am Horn von Afrika erregt. In rechtlicher Hinsicht wirft diese Verwendung der Streitkräfte schwierige verfassungsrechtliche Fragen auf, deren Beantwortung sich der Verfasser dieser Arbeit widmet. Es wird untersucht, inwieweit das Grundgesetz zu solchen Verwendungen der Streitkräfte ermächtigt und welche Anforderungen es an die Art und Weise eines solchen Einsatzes stellt. Konkret wird der Frage nachgegangen, inwieweit die Streitkräfte hierbei an die Grundrechte gebunden sind.
