Der Kampf gegen »safe havens« für Terroristen und die Schaffung internationaler Strafgerichte zeigen: Die Auffassung, schwerste Straftaten dürften nicht ungesühnt bleiben, gewinnt weltweit an Boden. Ein Weg dahin führt über die Aufenthaltsstaaten der Täter, die zur Auslieferung oder Strafverfolgung - lateinisch »aut dedere - aut iudicare« - verpflichtet sind. -- Christian Maierhöfer untersucht die historischen Wurzeln dieses Pflichtenbündels, stellt seine Ausgestaltung im heutigen Völkerrecht dar und setzt es in Beziehung zur internationalen Strafgerichtsbarkeit. Im Vordergrund steht die Untersuchung der Praxis von »Drittstaaten« bei der Verfolgung »internationaler Verbrechen« sowie der Versuch einer Systematisierung der vertraglichen »aut dedere - aut iudicare«-Regelungen.
