orsten Soffner untersucht die tatsächlichen und verfassungsrechtlichen Möglichkeiten eines frühzeitigen Einsatzes von Mediation im Sozialrecht. Denn trotz der hohen Konfliktanfälligkeit des emotional aufgeladenen Sozialverwaltungsverfahrens wird Mediation gerade hier – an der Konfliktwurzel – bislang praktisch nicht verwendet. Anhand einer Begriffsanalyse zeigt der Autor auf, dass dafür eine Glaubwürdigkeitskrise des deutschen Mediationsbegriffs mitursächlich ist. Als Ausweg wird eine wortgeschichtlich begründete Definition von »Mediation« erarbeitet. So definiert, lässt sich ein großes tatsächliches Potential der Mediation gerade für das Sozialverwaltungsverfahren nachweisen. Eine verfassungsrechtliche Analyse zeigt jedoch: Nicht erfüllte Gesetzesvorbehalte treffen auf ein vom Autor eigens entwickeltes, sozialverfassungsrechtliches Kooperationsgebot – mit besonderen Kommunikations- und Kooperationspflichten des Sozialstaats. Der Autor begründet damit die Pflicht von Bund und Ländern, das Sozialverwaltungsverfahren hinreichend kooperativ auszugestalten und Mediation zu ermöglichen. Die Arbeit schließt mit Formulierungsvorschlägen für eine entsprechende Gesetzgebung.
