Kaum ein aktueller Musiktitel im Pop, der elektronischen Musik oder der Black Music kommt ohne die Verwendung von Samples aus, mittels derer einzelne Töne, Geräusche oder Tonfolgen aus Live-Darbietungen oder von Tonträgern in neue Musikproduktionen übernommen werden. Aus diesem Grund wird sich jeder Musikschaffende, der sich mit der Produktionsform des Samplings befasst hat, schon einmal die Frage gestellt haben: Wann ist Sampling erlaubnis- und sanktionsfrei möglich?Das vorliegende Buch versucht sich an einer Beantwortung der Frage und zeigt auf, in welchen Konstellationen die Erstellung und Übernahme von Samples ohne Einwilligung der Rechteinhaber möglich ist und wann – unter Berücksichtigung der fortschreitenden Harmonisierung des Urheberrechts – in das Urheberrecht der Komponisten von Musik und Text sowie in das Leistungsschutzrecht der ausübenden Künstler und der Tonträgerhersteller eingegriffen wird.

Sampling is one of the most important types of production in music today. Hardly any tracks in pop, electronic or black music can get by without using samples, in which single notes, sounds or melodies from live performances or from sound recordings are copied and used in the production of new music. This is the reason why every music maker faced with sampling will have asked themselves when it is possible for sampling to be free from permission and sanctions. This book attempts to answer this question by illustrating the various constelltions in which the compilation and copying of samples is possible without the consent of the rights holders and at what point, taking the progressive harmonisation of copyright law into consideration, the copyright of the composers of music and lyrics as well as the ancillary copyright of performing artists and producers of sound recordings is infringed.
