Die Arbeit untersucht, welchen primärrechtlichen Grenzen Normungsorganisationen im Europarecht unterliegen, wenn sie Standards beschließen. Normen sollen Anforderungen an Produkte oder Dienstleistungen vereinheitlichen. Sie existieren für beinahe jeden Lebensbereich. Obwohl sie zunächst rechtlich unverbindlich sind, kann ihre Einhaltung auf Grund ihrer rechtlichen und ökonomischen Wirkungen faktisch verbindlich sein. Die an der Normerstellung Beteiligten haben damit im Einzelfall die Macht, darüber zu entscheiden, was in Zukunft normkonform ist und was nicht, welche Produkte von Verbrauchern vermehrt gekauft und von Zulassungsbehörden und Gerichten mit großer Wahrscheinlichkeit als sicher angesehen werden. Die Arbeit zeigt, dass diese Macht – unabhängig von der Rechtsform der Organisationen - den Bindungen des EU-Wettbewerbsrechts und der Grundfreiheiten unterliegt. Beschränkende Standards müssen am Maßstab des Verhältnismäßigkeitsprinzips gerechtfertigt werden.
