Das Bild von Verbrauchern, die digitale Leistungen mit ihren Daten „bezahlen“, suggeriert eine Preisbildung, die nicht stattfindet. Denn die Datenintensität (also der „Datenpreis“) digitaler Leistungen bleibt für Endnutzer meist im Dunkeln. Dennoch hält die DS-GVO an der Einwilligung als maßgeblicher Verarbeitungsgrundlage für datenintensive Leistungsangebote fest und beschreitet damit einen privatrechtlichen (auf Privatautonomie setzenden) Weg. Eine zeitgemäße – grundrechtssensible – privatrechtliche Perspektive auf das Datenschutzproblem gibt vor diesem Hintergrund wichtige Orientierung für die Dogmatik des Verbraucherdatenschutzes, insbesondere zum Anwendungsbereich der Einwilligung und den Grenzen ihrer vertraglichen Kopplung.
