Darin fragt der Jurist nach dem Wesen der menschlichen Gemeinschaft; für ihn eine der zentralen Fragen der Rechtswissenschaft. Denn für Gierke ist das Recht Teil des Gemeinschaftslebens, während gleichzeitig die Ordnung des Gemeinschaftslebens Teil des Rechts ist. Er gibt hier einen knappen Abriss seiner Lehre von der realen Verbandspersönlichkeit und verteidigt sie gegen die beispielsweise von Friedrich Carl von Savigny vertretene Fiktionstheorie.
