Trotz internationaler Bemühungen um den Schutz der Menschenrechte kommt es besonders in Diktaturen immer wieder zu schweren Menschenrechtsverletzungen wie systematischen Folterungen, Vergewaltigungen, Völkermord und extralegalen Tötungen politischer Gegner. Opfer bzw. ihre Angehörigen ersuchten um Rechtsschutz und verklagten die Täter oder den Täterstaat vor den Gerichten ihres Heimatstaates oder eines Drittstaates. Wenn es sich bei den Beklagten um ausländische Staaten, deren Staatsoberhäupter und Regierungsmitglieder oder andere staatliche Funktionsträger handelt, muss das angerufene Gericht untersuchen, ob völkerrechtliche Grundsätze der Staatenimmunität die Durchführung eines Verfahrens verbieten. Der Autor arbeitet aus einer Vielzahl von Entscheidungen nationaler sowie internationaler Gerichte und umfangreicher Literatur die wesentlichen Ansätze heraus, analysiert sie und ermittelt anhand der völkerrechtlich anerkannten Methoden den aktuellen Stand des Völkerrechts.
