Die Arbeit - in der Darstellungsweise ausgerichtet an dem rechtspositiven Richtigkeitskriterium, alles Recht als System erfassen zu können - fragt nach der Bedeutung des Zeitmoments für die Leistung. Die Antwort erfordert eine umfassende Untersuchung des Leistungsbegriffs. Dabei weist Patrick Schmidt nach, daß aus diesem das versprechensgemäße Handeln des Schuldners nicht ausgeklammert werden kann und infolge dessen das geltende Recht unverändert keine Fälle kennt, in denen der Schuldner zur Leistung nicht länger verpflichtet ist, wohl aber für deren Nichterbringung haftet. Da, wie weiter dargestellt wird, die Rechtzeitigkeit der Leistung regelmäßig nicht Inhalt der Leistungsverpflichtung des Schuldners i. e. S. ist, stellt sich die Kongruenz der Voraussetzungen von Schuld und Haftung zwar zunächst als eine doppelte (Leistung / Leistungsrechtzeitigkeit) dar; materiell betrachtet jedoch erlangen die Verzögerungsregeln eine Zentralstellung.
