Christiane Richter beschäftigt sich mit der grundlegenden Frage der Abgrenzung von Regelungsgewalt zwischen Gemeinschaft und Mitgliedsstaaten unter dem besonderen Blickwinkel des Instituts des nationalen Alleingangs. Im Focus steht dabei ein komparativer Untersuchungsansatz, der die unterschiedlich hohen Voraussetzungen eines Alleingangs im Binnenmarkt einerseits und im gemeinschaftlichen Umwelt- und Verbraucherrecht andererseits in Ursache und Folge darstellt. Mitgliedstaatliche Regelungsgewalt gilt weiterhin als ein Hindernis für einen einheitlichen Binnenmarkt. Die Chance, nationales Potenzial als innovatives Moment zur Förderung hoher Regelungsstandards zu nutzen, wurde bisher vergeben. In einem flexiblen und weiter wachsenden Europa gestaltet sich die künftige Weiterentwicklung der Schutzstandards zu einem einheitlichen Schutzverstärkungssystem aber wichtiger denn je.
