Die Arbeit untersucht die Beihilfestrafbarkeit von Angehörigen des Konzentrationslagers Auschwitz, die ausschließlich eine untergeordnete Rolle im Vernichtungsapparat und -prozess eingenommen haben. Im Kern steht dabei die kritische Würdigung der Rechtsprechung des Bundesgerichthofs, der die Beihilfe zum Mord im Fall Oskar Gröning an das Merkmal der allgemeinen Dienstausübung anknüpfte. -- Die Arbeit verdeutlicht, dass sich der Lösungsansatz des Bundesgerichthofs im Widerspruch mit der bisherigen höchstrichterlichen Rechtsprechung befindet, mit der Folge, dass jedem im Lager Tätigen eine Beihilfe vorgeworfen werden kann, unabhängig von seinem individuellen Tatbeitrag. Zur Beschränkung dieser weiten Zurechnung stellt der Autor Restriktionskriterien vor, die eine Ausuferung der Strafbarkeit verhindern. Im Anschluss wird für weitere Gruppen von systematisierten Verbrechensbegehungen ein kombinierter Lösungsweg aus dem Rechtsprechungsansatz und den Restriktionskriterien aufgezeigt.
