In den nach dem ersten Weltkrieg von Deutschland an Polen abgetretenen Gebieten galt u. a. das Sachenrecht des BGB (3. Buch) fort. Die Analyse der polnischen Rechtsprechung zum 3. Buch durch polnische und deutsche Autoren versteht sich als Beitrag zur Klärung der Frage der Gleichartigkeit oder durch kontextuelle Unterschiede bedingten Divergenz der bei einer Anwendung wortgleicher Privatrechtsnormen durch Gerichte verschiedener Staaten erzielten Ergebnisse. Für das Untersuchungsgebiet ergibt sich eine ganz überwiegende Parallelität zur deutschen Judikatur. Die Gründe hierfür liegen in der Orientierung der Richter an den Sachproblemen und in der Möglichkeit des Rückgriffs auf nicht zuletzt von der römisch-pandektistischen Tradition geprägte gemeinsame Auslegungstopoi. Damit ist zugleich eine günstige Perspektive eröffnet für die Entwicklung eines EU-Sachenrechts mit der Notwendigkeit einer europaweit einheitlichen Anwendung der sich auf gemeinsame Wurzeln gründenden Rechtsnormen
