Die "Allgemeine Erklärung der Menschenrechte" der Vereinten Nationen (UN) von 1948 formulierte das Recht auf Gesundheit als das zu erreichende gemeinsame Ideal. Bereits 100 Jahre vor der Deklaration der Menschenrechte hat der jüdische Arzt Salomon Neumann in einer Schrift zur Reform der preußischen Medizinalverfassung "Die öffentliche Gesundheitspflege und das Eigenthum", für jeden Bürger Gesundheit als Recht definiert und deren Schutz durch ein öffentliches Gesundheitswesen gefordert und dies mit einer über die zeitnahe sozialkritische Diskussion hinausgehenden Argumentation begründet. Die Frage nach der Anerkennung des Menschenrechts auf Gesundheit ist international und national beantwortet, die nach einem Grundrecht für Gesundheit ist in der Bundesrepublik offen.
