Pränataldiagnostik (PND) und/oder -therapie sind integraler Bestandteil der Geburtshilfe. Dabei steht der informative, über Beratung nicht selten lebenserhaltende und zunehmend auch intrauterin therapeutische Ansatz im Vordergrund. Zweifellos haben Urteile von Bundesgerichtshof und Bundesverfassungsgericht (1997) die Beratungspraxis und auch die Einstellung zur Pränataldiagnostik insofern beeinflusst, als wir in der ethischen Bewertung nicht mehr nur fragen, ob wir tun dürfen, was machbar ist, sondern ob wir letztlich tun müssen, was medizinisch möglich ist. So steht zzt. die Kompatibilität der Präimplantationsdiagnostik mit dem Embryonenschutzgesetz (ESchG) im Mittelpunkt der juristischen Diskussion. Diese wird vom wissenschaftlichen Beirat der BÄK bejaht. Sollte diese Position durch den Deutschen Bundestag abgelehnt werden, muss er sich spätestens dann den Wertungswidersprüchen zwischen dem hohen Schutzanspruch für den Embryo in vitro durch das ESchG und dem Verzicht auf rechtliche Sanktionierung der Präimplantationsphase in vivo durch § 218 StGB mit Zulassung von Nidationshemmern sowie der Legitimierung der Schwangerschaft auf Probe mit PND und Spätabbruch stellen
