    Content: In den letzten Jahren wurden die bundesrechtlichen Terrorismusabwehrmaßnahmen in Deutschland verschärft und ihr Einsatzzeitpunkt weit in das Vorfeld eines konkreten Anschlags vorverlagert. Dies führt zu einem großflächigen Überschneidungsbereich von gefahrenabwehrrechtlichen und strafprozessualen Ermittlungsmöglichkeiten und verändert die operative Ausrichtung der Sicherheitsarchitektur. Diese Veränderungen sind insbesondere unter Verhältnismäßigkeitsgesichtspunkten bedenklich und werden im Rechtsvergleich zu den USA kritisch gewürdigt. Im Ergebnis zeigt diese Arbeit, dass rechtspolitischer Handlungsbedarf besteht, und entwickelt entsprechende Handlungsvorschläge.
    Content: In recent years, federal counter-terrorism measures in Germany have been tightened and the point of intervention has been shifted far into the field prior to a specific attack. This causes a large-scale overlap between the possibilities for investigations under counter-terrorism law and those under criminal procedure, and is changing the operational orientation of the security architecture. These changes are particularly questionable from a proportionality point of view and are critically assessed in a legal comparison with the USA. As a result, this paper shows that there is a need for legal policy action and develops corresponding proposals for action.
